The Georgia Department of Banking and Finance is responsible for supervising those who are licensed (or who should be licensed) to do business in the residential mortgage industry in Georgia. Residential mortgage lenders and brokers must apply to the Department and meet certain licensing standards before they may legally offer their services to the public. A "Registrant" is a company that, due to its charter and ownership structure, has been specifically exempted from licensing. Certain types of companies are exempt from the licensing provisions of Georgia law. These exemptions extend to organizations such as banks which are properly chartered in Georgia, and to properly licensed finance companies who restrict their lending activities to those covered by the Georgia Industrial Loan Act (GILA).

Federally-insured depository institutions chartered in states other than Georgia are "notificants" only and are not regulated or supervised by our agency. Please check the following list of names. We DO NOT regulate these entities and we cannot answer any questions regarding their operation. Please Note: No license or exemption from licensing is required to make loans on rental property and second homes. These types of loans are excluded from the definition of"residential property" under the Georgia Residential Mortgage Act.
If you have a complaint about a Georgia licensed or registered residential mortgage broker, lender or processor, the Department suggests that you send a written complaint directly to the company by certified mail. The Department has made all licensees/registrants aware that they will receive complaints directly from consumers. The Department's expectation is that all entities will make good faith attempts to resolve all issues or complaints directly with consumers within a reasonable period of time.
While complaint processing times may vary, on average you should receive a written response from the licensee within 30 days of receipt of your complaint. If after the 30 days you have received no response from the company, please contact the Department at (770) 986-1633. Be prepared to provide documentation that the licensee received your complaint (e.g., certified mail receipt).

Settlement Procedures: (FHA and non-FHA mortgages). Visit the RESPA web page for information on RESPA disclosure requirements such as the Good Faith Estimate, HUD-1 and escrow account statements, and how to file a complaint with your lender concerning the servicing of your loan.
