Georgia Department of Banking and Finance's Order to Cease and Desist issued to Jason Fenchuk Becomes Final

Atlanta, Georgia ~ On December 3, 2009, the Order to Cease and Desist issued by the Georgia Department of Banking and Finance (“Department”) to Jason Fenchuk of Atlanta Discount Home Loans d/b/a America's Discount Home Loans became final.  

Mr. Fenchuk was issued an Order to Cease and Desist by the Department for withholding information requested by the Department and making false statements or material misrepresentations to the Department in violation of O.C.G.A. § 7-1-1013(11); refusing to permit an investigation or examination of books, accounts and records in violation of Department Rule 80-11-2-.01(6)(b); failing to deliver funds obtained in connection with a mortgage loan in violation of O.C.G.A. § 7-1-1013(5) and (6); and, failing to properly maintain a mortgage loan transaction journal in violation of Department Rule 80-11-2-.03.

Pursuant to state law, the Department may revoke the license of a mortgage broker or lender that employs an individual against whom a final Order to Cease and Desist has been issued within the preceding five years if the Order resulted from misrepresentations being made in loan documents.
