Atlanta, Georgia — Orders to Cease and Desist against the following, which were issued by the Georgia Department of Banking and Finance (“Department”) on August 21, 2017, have become final:

  1. Tommie Gaines, located at 2330 Scenic Highway, Snellville, GA 30078;
  2. James Bueckers, located at 860 Johnson Ferry Rd NE, Ste 140-326, Atlanta, GA; and
  3. Kadinn and Associates, located at 860 Johnson Ferry Rd NE, Ste 140-326, Atlanta, GA 30342.

The Orders to Cease and Desist were issued by the Department after it obtained evidence that the above-listed persons engaged in residential mortgage lending, brokering, and loan originating activities without a license or under an applicable exemption in violation of O.C.G.A. § 7-1-1002.

Georgia law prohibits any person from engaging in the following mortgage activities without a mortgage license or pursuant to an exemption from licensure:

  • Take a residential mortgage loan application or offer or negotiate terms of a residential mortgage loan;
  • Directly or indirectly solicit, process, place, or negotiate mortgage loans for others, or offer to solicit, process, place, or negotiate mortgage loans for others without a mortgage license or pursuant to an exemption from licensure; or
  • Directly or indirectly make, originate, or underwrite mortgage loans.

The Department is the state agency that regulates and examines Georgia state-chartered banks, state-chartered credit unions, and state-chartered trust companies. The Department also has responsibility for the supervision, regulation, and examination of Merchant Acquirer Limited Purpose Banks (MALPBs) chartered in Georgia.  In addition, the Department has regulatory and/or licensing authority over mortgage brokers, lenders and processors, mortgage loan originators, check cashers, sellers of payment instruments, money transmitters, international banking organizations, and bank holding companies conducting business in Georgia.
